Terms of Service

These Terms of Service ("Terms") govern your access to and use of AtomPing uptime monitoring services ("Service") provided by Atomix Apps, LLC ("Company", "we", "us", "our"), a Delaware limited liability company.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

To use AtomPing, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated.

You are responsible for safeguarding your password and for all activities that occur under your account. You must immediately notify us of any unauthorized use at support@atomping.com.

Free Plan: The Free plan is intended for personal, non-commercial use. It includes limited monitoring checks and basic features.

Paid Plans (Pro/Business): Commercial use requires a paid subscription with increased check frequency, multi-region monitoring, and advanced features.

You may not use the Service to:

• Monitor illegal content or services
• Perform excessive requests that overload our infrastructure
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract source code

AtomPing provides uptime monitoring services including:

• HTTP/HTTPS website monitoring
• SSL certificate expiration tracking
• ICMP ping monitoring
• TCP port monitoring
• DNS record monitoring
• Keyword/content change detection
• Cron job/heartbeat monitoring
• PageSpeed/Core Web Vitals tracking

Monitoring intervals, regions, and features vary by plan. We reserve the right to modify features and limitations with notice.

Paid subscriptions are billed monthly or annually via Stripe. All fees are in USD and non-refundable except as required by law.

Refund Policy: You may request a full refund within 14 calendar days of your initial purchase. Renewal charges are non-refundable.

Subscriptions automatically renew unless canceled before the renewal date. You can cancel anytime from your account settings.

The Service and its original content (excluding user-submitted monitoring targets), features, and functionality are owned by Atomix Apps, LLC and protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your monitoring targets and data. We claim no intellectual property rights over the content you monitor.

You retain ownership of all data you provide to AtomPing, including monitored URLs, credentials, and configuration settings.

By using the Service, you grant us a limited license to process your monitoring data solely to provide the Service. We will not sell or share your monitoring data with third parties except as described in our Privacy Policy.

We strive to maintain 99.9% uptime for Pro and Business plans. However, the Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. We are not liable for any modification, suspension, or discontinuance of the Service.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time from account settings. Data may be retained for up to 30 days for backup purposes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that monitoring results will be 100% accurate. You use the Service at your own risk.

IN NO EVENT SHALL ATOMIX APPS, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability to you for all claims arising from or related to the Service shall not exceed the fees you paid us during the twelve (12) months preceding the claim.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

You agree to indemnify and hold harmless Atomix Apps, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you monitor through the Service

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.
